Terms of Service
These Terms of Service govern your access to and use of IntelaCare Longevity, a service of IntelaCare PBC. Please read them carefully.

1. Acceptance of Terms
Welcome to IntelaCare Longevity, a service of IntelaCare PBC (“IntelaCare,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) form a binding agreement between you and IntelaCare PBC and govern your access to and use of the IntelaCare Longevity website, applications, and related services (collectively, the “Services”). By accessing or using the Services, creating an account, or submitting an enrollment request, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
2. Description of Services
IntelaCare Longevity provides technology-enabled chronic care support and remote care services for eligible individuals. These may include virtual communication with a care team, monitoring and interpretation of health readings you share, educational information, medication support, and coordination with your existing providers. The Services support the ongoing management of chronic conditions and are delivered remotely. The specific features available to you may depend on your eligibility, your condition, and applicable program rules. We may modify, add, or remove features from time to time.
3. Not for Emergencies
The Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Services to request emergency or urgent care. Our care team may not see your messages in real time, and the Services are not a substitute for emergency care, urgent care, or calling your local emergency number.
4. Eligibility
To use the Services you must be at least 18 years of age and able to form a binding contract. Enrollment in the chronic care program is limited to individuals with Original (Traditional) Medicare, Part A and Part B, who meet the applicable clinical criteria. Medicare Advantage (Part C) members are not currently eligible. We verify eligibility and coverage before enrollment is finalized. You agree to provide accurate, current, and complete information and to keep it up to date.
5. Nature of Telehealth
Telehealth involves the delivery of health care services using electronic communications, information technology, or other electronic means between a provider and a patient who are not in the same physical location. Telehealth may be used for assessment, monitoring, education, care coordination, and related services. The same standards of care and the same privacy protections that apply to in-person care apply to telehealth. There are potential benefits and potential risks to telehealth. In rare cases, information transmitted may not be sufficient (for example, because of poor image or data quality), or technical problems may delay or disrupt care.
6. Informed Consent to Telehealth
By using the Services, you acknowledge that you understand and consent to receiving care through telehealth. You understand that:
- You have the right to withhold or withdraw consent at any time without affecting your right to future care.
- The laws that protect the privacy and confidentiality of health information apply to telehealth.
- You may seek in-person care at any time.
- Your care team will determine whether your condition is appropriate for telehealth and may recommend in-person care when needed.
You consent to the electronic transmission of your health information as reasonably necessary to provide the Services.
7. No Guarantee of Outcomes
Health outcomes depend on many factors, including factors outside our control. We do not and cannot guarantee any particular result, improvement, diagnosis, or outcome from your use of the Services. Any information provided through the Services is for general support and educational purposes and does not replace the judgment of your treating providers.
8. Prescriptions
The Services may include support related to your medications, such as reminders and prescription order updates. Where prescribing occurs, it is performed only by a licensed provider acting within the scope of their license and applicable law, and only when clinically appropriate following an evaluation. We do not guarantee that any medication will be prescribed. We do not prescribe controlled substances through the Services except as permitted by applicable law. You are responsible for following your providers' instructions and for filling any prescription at a pharmacy of your choice.
9. Accounts
You may need to create an account or provide contact information to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We may suspend or terminate your account if we reasonably believe you have violated these Terms.
10. Fees
For eligible beneficiaries, covered Services are provided at no out-of-pocket cost under the applicable Medicare program. We do not charge for the enrollment request itself. If any Service is not covered, we will tell you in advance, and you are responsible only for amounts you expressly agree to pay. Any applicable fees will be disclosed to you before they are incurred.
11. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Provide false, inaccurate, or misleading information;
- Access the Services on behalf of another person without authorization;
- Interfere with or disrupt the Services or their security;
- Attempt to gain unauthorized access to any systems, accounts, or data;
- Use the Services to transmit harmful or unlawful content; or
- Use automated means to access the Services without our permission.
12. Intellectual Property
The Services, including all content, software, text, graphics, logos, and design, are owned by IntelaCare PBC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your personal, non-commercial use in connection with your care. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our prior written permission.
13. Third-Party Services
The Services may rely on or link to third-party products, services, or websites, including messaging carriers, device makers, and analytics providers. We do not control and are not responsible for third-party services, and your use of them may be governed by their own terms and privacy practices. Any reference to a third party does not imply our endorsement of that third party.
14. SMS Messaging Terms
If you opt in to receive text messages, the following terms apply to the IntelaCare Longevity SMS program.
- Program description. The IntelaCare Longevity SMS program sends appointment reminders, prescription order updates, account verification codes, and support responses to the mobile number you provide.
- Message frequency. Message frequency varies.
- Rates. Message and data rates may apply.
- Cancel. Reply STOP to cancel at any time. After you reply STOP, we may send one message confirming that you have been unsubscribed.
- Help. Reply HELP for help, or contact us at support@intelacarelongevity.com.
- Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.
- Not a condition of purchase. Your consent to receive SMS messages is not a condition of any purchase or of enrollment in or receipt of care.

15. Disclaimers
Except as expressly stated, the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Nothing in these Terms limits any warranty or protection that cannot be excluded or limited under applicable law.
16. Limitation of Liability
To the fullest extent permitted by law, IntelaCare PBC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for professional negligence in the provision of clinical care.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless IntelaCare PBC and its affiliates from and against any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Services.
18. Governing Law
These Terms are governed by the laws of the state in which IntelaCare PBC is organized, without regard to its conflict of laws principles, except where applicable law requires otherwise. Any dispute arising out of or relating to these Terms or the Services will be resolved in the courts located in that state, unless applicable law provides otherwise.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date shown above. Changes become effective when posted. Your continued use of the Services after changes become effective means you accept the revised Terms. If you do not agree to the changes, please stop using the Services.
